Allocation of Duties for Garden Handover under Art. 256 / 259 CO

Clear distinction between tenant maintenance and landlord responsibility at lease termination

01Tenant Duty

Lawns & Paving Joints

Tenant responsibility (minor maintenance): Final lawn cut to 4–5 cm, removal of dandelions and moss from paving joints.

02Tenant Duty

Beds & Shrubs (Within Reach)

Tenant responsibility: Weeding, annual shape trimming of year-old shoots, clean covering with fresh bark mulch.

03Landlord Duty

Mature Trees & Crown Pruning

Landlord responsibility: Safety and thinning cuts on tall trees and any work requiring rope-access techniques.

04Landlord Duty

Root Stumps & Plant Senescence

Landlord responsibility: Replacement of dead perennial hedges and repair of frost-damaged garden walls.

1. What Qualifies as 'Minor Maintenance' for Gardens? (Art. 259 CO)

When renting an apartment with a private garden or a terraced home, Art. 259 CO in conjunction with Art. 256 CO governs upkeep. Unless permissible special agreements were made in the lease, tenants are exclusively responsible for ordinary, simple garden work that can be carried out without horticultural expertise or costly machinery.

When disputes arise at move-out, property managers often attempt to charge full landscape redesigns to the tenant deposit. Before Zurich conciliation authorities, however, such claims routinely fail if the tenant can demonstrate standard routine maintenance.

  • Included in Minor Maintenance: Lawn mowing during the growing season, weeding borders and flower beds, removing moss and weeds from patio slabs, light trimming of withered perennials.
  • Not Required from Tenants: Professional crown pruning of mature deciduous trees, root milling, repairing vole damage, replanting desiccated thuja hedges due to age-related decline.
  • Cost & Risk Criterion: Tasks requiring specialized training or carrying safety hazards (work on tall ladders) fall squarely under landlord maintenance duties.

Beware of Unlawful Lease Clauses

Clauses in tenancy agreements such as 'The tenant is liable for professional garden restoration by a landscaping company upon departure' are void under established legal precedent if they shift the statutory framework of Art. 256 CO excessively against the tenant.

2. The 4 Levers for a Defect-Free Garden Handover

Property surveyors and housing inspectors assess gardens primarily by their visual degree of care. Four targeted actions establish the required 'clean and compliant' state without days of strenuous physical labor:

  • 1. Edging Lawns (Duration: approx. 30 minutes): Use an edging spade to cut a crisp, straight boundary between lawn grass and patio slabs or beds. This instantly conveys geometric tidiness.
  • 2. Bark Mulch Method on Beds: Pull visible weeds and dandelions, then lay a 4–5 cm layer of fresh bark mulch. This suppresses weed seeds, smells fresh like a forest floor, and looks as if professionally landscaped.
  • 3. Joint Cleaning on Patio Slabs: Paving slabs must not exhibit dense clumps of moss or grass between seams. A manual patio joint scraper or pressure washer with surface cleaner resolves this rapidly.
  • 4. Clearance of Access Paths: Branches and foliage must not obstruct walkways, garden lighting, or entryways (maintaining minimum clearance envelopes).

3. Parity Lifespan Table for Garden Elements: Fences, Lawns, and Plants

If the garden has suffered wear from playing children, pets, or neglect, the joint Parity Lifespan Table of HEV and the Tenants' Association (MV) applies equally to outdoor installations. Tenants never owe replacement at new value:

  • Wooden Fences (Pressure-Treated): 15-year lifespan — after 15 years, the residual fair market value is CHF 0.
  • Metal Fences / Chain-Link Fencing: 25 to 30 years lifespan.
  • Lawn Areas (Re-seeding after heavy use): 8 to 10 years lifespan. Spot damage only requires low-cost patch reseeding rather than entire turf replacement.
  • Annual Flowers & Perennials: Deemed tenant property upon planting; need not be replaced upon departure as long as soil is handed over weeded.

4. Defending Against Deposit Deductions: Inspection Protocol & Notice Deadlines

Many landlords withhold thousands of francs from rental deposits citing alleged 'garden neglect'. Swiss tenancy law protects tenants through strict formal notice rules:

Under Art. 267a CO, landlords must inspect property conditions immediately upon handover and notify tenants of defects promptly. If the handover protocol is unsigned or garden objections are only raised weeks after keys were returned, landlord claims are generally forfeited under Art. 267a para. 2 CO.

Mondar coordinates complete move-out cleans including outdoor terraces and power-washing with guaranteed acceptance.
